Mediations/Arbitrations/Special Master Appointments

David has participated in hundreds of mediations as an advocate during his career. At the urging of two local district judges, David finally enrolled in and completed the certification training to serve as a court-appointed mediator. Since that time, David has been appointed by various courts, has been certified as a mediator for the United States District Court, Southern District of Texas, and has been requested by dozens of counsel in pending lawsuits to serve as a mediator. The results speak for themselves.

From the multi-party wrongful death case or the complex commercial dispute, to the most direct intersection collision case, David's mediation abilities have proven critical to the parties in resolving and documenting the end of the lawsuits.

These same sets of skills have convinced local district judges in two counties to appoint David on two separate occasions as a "Special Master" pursuant to the applicable provisions of the Texas Rules of Civil Procedure to assist the Courts in resolving legal and discovery disputes between the parties. This service to the Court has involved deciding, as a Special Discovery Master, pretrial and discovery issues in a complex, multi-party auto products liability case with nationwide implications, and in several complex construction defect cases involving dozens of parties and counsel. In addition, David was also appointed as a Special Master to assist the Court in apportioning the available settlement proceeds in a hotly disputed multi-party double death wrongful death action and to review medical records in camera to address concerns about privacy in a discovery dispute.
